Bi speak directly to his Hawaii fans on KGMB TV Channel 9 News tonight. Bi assured everyone that he had no knowledge of concert cancellations and that
he really wants to perform in Hawaii and that he may do the planning and organizing himself
so everything will be done correctly.

Rain will use his name for US concerts, US court dismissed the law suit

World Star, Rain is able to use his name for US concerts after all.
StarM, who conducting Rain’s world tour, announced US court dismissed the law suit from Rain Corp. which requesting not to use Rain name in Rain’s concert in USA on 22nd of June.

Earlier, Rain Corp. from Nevada filed law suit requesting Rain should not use name Rain for his USA concerts.

This company has Beatle Tribute band called ‘Rain’ and the reason for the law suit was they have the service right register for the name, Rain.
They filed the law suit for service right on Feb. 22 and also filed the request Rain to stop the US concert tour. Therefore Rain’s US concert became a vague and ended up postponing US concerts.

StarM said, “US concerts are already postponed so we are discussing reschedule of concerts (ATL, NY, SF, LA) will release new schedule once it is decided”.

Rain will perform LA concert on Jun. 30 and head to Berlin, Germany to shoot his new movie, Speed Racer.

Aw, do you know why they cancelled the SF concert? I totally would have gone because Cow Palace is like 15 minutes away from where I live!! Was there not enough interest?

Don't think my mom would let me fly to LA to watch a concert...=(

Due to legal battles surrounding his name, Rain is postponing his US concerts. Rain Corporation, a music company based in Nevada manages a band named Rain and they asked Korean Rain to drop the name “Rain” while he performs in the states back in February. Who is this Rain, the classic rock band? According to their website, they are “about good times and putting the audience on the dance floor” by playing old time favorites from the 60s and 70s. Who knew that bunch of middle aged White dudes balding with beer bellies can stop Rain from dominating the world? It’s rather hysterical if you ask me and I also think that this is the perfect excuse time for Rain to come up with a new name. What would you name the Korean Rain?

*Star M, the organizer of It’s Raining concert will announce new dates for Rain’s concert as soon as they settle the legal battle on the 14th of this month.

Rain explains that the case is being carefully handled. Although it will not affect his world tour in the US, he cannot carry on with his concert because it might be a problem in the future. He plans to solve it completely before having a concert in the US. Thus, he had to postpone it.

A company in California called “Rain Corporation” is going to use the word “Rain” to hold concerts in the US. On 20th February, they requested for a prohibition for others to use the word “Rain”

Rain said with much regrets that based on the information they got from a lawyer in the US, the name “Rain” has been used six times but they only filed a lawsuit again Rain. They suspect that they might have other motives.

They believe that Rain Corporation’s litigation would be dismissed but in case of any unexpected results, they decided to postpone it.

They said that the court would announce the verdict on the 14th, a day before the concert in Hawaii. So if the concerts still carries on, they are afraid that the negative consequences will affect the fan. Thus, they made a difficult decision.

They said that after the verdict is announced, they will reschedule the dates for the concerts in Hawaii, Atlanta, New York, San Francisco, LA etc…

U.S. Band Rain Thwart's Korean Star's American Tour

The Korean singer Rain’s concerts in the U.S. as part of his world tour have been postponed due to controversy over his stage name. His Korean name “Bi” means “rain” in English, but the singer faces legal action filed by U.S. recording firm Rain Corporation with the District Court-District of Nevada in February. The company, which works with an American band also called Rain, demanded the entertainer drop the English name in the U.S.

Star M Entertainment, the organizer of the singer’s world tour, said it did its utmost to reach agreement with the U.S. company, but the concert schedule had to be changed since the court will make a ruling on June 14, when the Korean singer was scheduled to perform in Hawaii, the first leg of his U.S. concerts. A Star M Entertainment spokesman said the singer will stage concerts in the U.S. after August, because he will be shooting the movie “Speed Racer” from July. The singer had scheduled concerts in Hawaii, Atlanta, New York, San Francisco and Los Angeles from June 15 to 30.

I have some more information after reading the case posted by Alex at Rain-USA.

This is what I have interpreted:

- Rain Corporation is a Nevada corporation
- They have used the service mark "Rain" since at least 1978 in relation to entertainment services in Nevada, US and other countries. They have spent hundreds of thousands of dollars advertising and promoting under the name "Rain". Includes services as a Beatles tribute band. They have been well recognised under this name and "relied upon by consumers as identifying the quality entertainment services of Rain and distinguishing those services from the services of others".
- September 1988 - They filed a federal trademark application for "Rain" to be used for entertainment services.
- August 24, 2005 - Defendants (Ji Hoon, JYP Entertainment, Star M) filed a trademark application for "Rain" but was rejected in May 18, 2006 as they found that it was likely to cause confusion between the two parties
February 2006 - Defendants performed under the Infringing Mark at Coliseum at Caesar's Palace in Las Vegas, with full knowledge of "Rain Corporation" and their superior rights.
- Defendant's unauthorised use of "Rain" creates a likelihood of confusion, mistake and deception. Actual confusion of consumers has occured.
- It is said that "Rain Corporation" will continue to suffer great and irreparable injury from the defendant's acts.
"Rain Corporation" wants to be awarded three times the profits attributable to Defendant's infringement, it's attorney's fees be paid, interest on any monetary award, an injunction be issued against defendants and their employees, Star M to cancel their domain name (http://rainworldtour.com) etc.

wow.. that is so lame. the concert is postponed because of that? i'm PRETTY sure most of his fans wouldnt confuse to the two and that they really only care about JH being there to perform. that's pretty ridiculous to file a suit like that in my opinion.. but i guess nowadays us americans are just too damn greedy sometimes >.<

Mother Nature to counter-sue Beatles cover Band "Rain"

Plans to team up with other angered Gods

Valhalla- Lawyers for Mother Nature have announced her plans to take suit against the cover band, Rain, for appropriation of the name of her own precipatatory phenomenon, rain. The band has recently come into the news for their own suit against Korean Pop star Rain (Bi). Mother Nature claims monetary damages as well as untold "emotional harms" because she is "deeply disturbed that an unoriginal cover band could use [her] name for a truly one-of-a-kind" natural phenomenon. "It brings a bad name to precipiation everywhere" she was quoted at this mornings press conference. Poseidon has joined the suit on behalf of Mother Nature saying he felt a strong affinity to her cause since he rules over the remaining natural waters found on planet Earth. Indeed, the announcement came as no suprise to most who are well aware of their collaboration over the millenia in creating our modern weather system. "He truly is, all jokes aside, the wind beneath my wings" Mother Nature said of the trident-wielding God of the Sea, alluding in jest to the formulation of warm and cold fronts as well as other storm systems that they have perfected over the years.

No word has come from the opposition who look to be embroiled in a number of legal battles as the summer wears on. A court date has not been announced as of the time of this publication.
