View Full Version : Which Bill of Rights would you eliminate?

If you had to eliminate one of the first ten amendments, which one would you choose? State which amendment and why you chose that one.

Here are the amendments:

Amendment I
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

Amendment II
A well regulated militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.

Amendment III
No soldier shall, in time of peace be quartered in any house, without the consent of the owner, nor in time of war, but in a manner to be prescribed by law.

Amendment IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Amendment V
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a grand jury, except in cases arising in the land or naval forces, or in the militia, when in actual service in time of war or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

Amendment VII
In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise reexamined in any court of the United States, than according to the rules of the common law.

Amendment VIII
Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Amendment IX
The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Amendment X
The powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.

I would say all those are very important, but not so much to the third amendment because I think there are other laws that would prohibit people in military forces to do such a thing.

wait who would eliminate one of our rights if we eliminate one then we're taking away what we can do (legally of course) but hey, I figure with all those other amendments that are stripping us of our rights, to get rid of one is inevitable anyways(with the way our government works, you can be sure to expect it)

Did you know that the CAnadians don't have the right to bear arms? Isn't that just like :O

I don't think I"d really like to disperse with any in the Bill of Rights, they're like precedents, we can keep them ;)

I really like our bill of rights :glug: I think for the most par to keep the US a "free" country we need them all. The only thing that makes me angry is in Japan certain areas smoking outside is illegal and they have rooms for people to go and smoke in...see I like the idea that all people who want to kill their lungs kill them together but dont bring the rest of us down with you! But see we could never do that in US since it would inflict with the whole "Civil rights, etc.."

IM DOING MY HOMEWORK ON BILL OF RIGHTS!!! wow. i think the right to bear arms would not be very good......i mean anyone could get a permit and use a gun for bad purposes.

The only real amendment to cut out would be the second amendment. It's revelance to the current times is small. Unlike the past where guns were nessecary to destroy, rape, and pillage Indians who would do the same to us, though I blame the Americans, that today we have little need for that due to the establishment of police and military force.

Amendment III seems kind of irrelevant these days in the US.

i quite like our bill of rights. the people who prepared this document(forgot the names... T_T) wanted the future generations to be prepared, in case of something like...a war...like now. -.- i think we're more 'free' than most countries. canada doesn't even allow dog crap on streets. O_O but canada is much MUCH more peaceful than the u.s. >.> what am i talking about.. -.-
